Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) governs use of the Envoy AI platform and services (the “Service”) provided by FreightMind AI, Inc. (d/b/a Envoy AI) (“Envoy”) and is incorporated into the Envoy AI Terms and Conditions (the “Agreement”) between Envoy and the customer (“you”, “your”, or “yours”). Capitalized terms not defined here have the meanings given in the Agreement. By accessing or using the Service, you and your Authorized Users agree to this AUP. Envoy may update this AUP from time to time, effective under Section 13.8 [Updates to Hosted Terms] of the Agreement.
1. General Restrictions
You will not, and will not permit any Authorized User or third party to:
(a) use the Service in violation of the Agreement or any applicable law;
(b) use the Service to develop, train, or benchmark a competing product or service;
(c) reverse engineer, decompile, disassemble, or attempt to derive the source code, models, or underlying structure of the Service, except as expressly permitted by law;
(d) rent, lease, sell, sublicense, distribute, or otherwise make the Service available to any third party, except for Authorized Users and Affiliates as permitted by the Agreement;
(e) circumvent any usage limit, rate limit, or access restriction;
(f) frame, mirror, scrape, crawl, or index any portion of the Service, or use automated means to access the Service other than Envoy-provided APIs;
(g) remove, obscure, or alter any proprietary notice; or
(h) take any action that imposes an unreasonable load on, interferes with, or disrupts the Service, Envoy’s systems, any Third-Party Provider, or any other user.
2. Content and Data
You will not use the Service to upload, store, transmit, or generate content or data that:
(a) you do not have all rights and consents necessary to provide to, or have processed by, the Service;
(b) is unlawful, defamatory, obscene, harassing, threatening, fraudulent, deceptive, or misleading, or that infringes or misappropriates any third party’s intellectual property, privacy, publicity, or other rights; or
(c) constitutes protected health information subject to HIPAA, cardholder data subject to PCI-DSS, government-issued identification numbers, biometric identifiers, or other sensitive or special-category personal data, unless expressly agreed by Envoy in writing under an appropriate addendum.
3. Communications Compliance
Without limiting Section 4 [Communications Compliance] of the Agreement, you will not, and will ensure your Authorized Users will not, use the Service to:
(a) contact any Recipient without the consent or other lawful basis required under applicable law for the channel and method used (including autodialed, prerecorded, or AI-generated voice calls and SMS messages);
(b) call or text any number on a federal or state Do-Not-Call list or on your internal do-not-contact list, except where permitted by law;
(c) initiate communications outside the hours permitted by applicable law;
(d) fail to identify the calling or sending party or make any disclosure required by law;
(e) record or transcribe a communication without making the disclosures and obtaining the consents required under applicable one-party and all-party consent laws;
(f) spoof or falsify caller-ID or sender information, misrepresent the origin or purpose of a communication, or impersonate any person;
(g) send unsolicited bulk communications, “spam,” or phishing, or promote fraudulent, deceptive, or unlawful schemes;
(h) transmit SMS messages without registering the applicable numbers or campaigns for A2P 10DLC (or any successor) messaging, or otherwise in compliance with applicable carrier and messaging-aggregator requirements.
You will promptly honor all opt-out, stop, and unsubscribe requests and will not re-contact a Recipient who has opted out except as permitted by law.
4. Artificial Intelligence
You will not use the Service to represent that an AI-generated communication originates from a live human where that representation is prohibited by applicable law, or to omit any disclosure of AI use that applicable law requires.
5. Security
You will not, and will ensure your Authorized Users will not:
(a) probe, scan, or test the vulnerability of the Service or any related system, or breach or circumvent any security or authentication measure, without Envoy’s prior written authorization;
(b) access any account, data, or system you are not authorized to access; or
(c) introduce or distribute malicious code, or engage in any activity intended to harm, disable, or gain unauthorized access to any system or data.
You will promptly notify Envoy at contact@tryenvoy.ai of any suspected security incident or unauthorized use of the Service.
6. Enforcement and Reporting
Envoy may investigate suspected violations and remove or disable access to offending content or configurations. Envoy may suspend or terminate the Service for a violation in accordance with the Agreement, report unlawful activity to authorities, and cooperate with Third-Party Providers in enforcing their policies. Suspension or termination for an AUP violation does not entitle you to any refund. To report a suspected violation, contact Envoy at contact@tryenvoy.ai.
